Welcome to HerWay. These Terms & Conditions (“Terms”) govern your access to and use of the HerWay mobile and web applications, services, websites, and related products (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

• You must be at least 18 years old and capable of entering a binding agreement.
• You are responsible for the accuracy of information provided and for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.

2. Service Description

HerWay enables partners to set shared rules, track commitments, and apply agreed-upon consequences such as small monetary fines or points adjustments. Participation is voluntary and rules must be mutually agreed upon between partners.

3. Payments & Stripe

• Payments are processed by Stripe. HerWay does not store full payment card details.
• All fines, transfers, or payouts are initiated voluntarily by users as part of mutually agreed rules.
• Fees, reversals, disputes, and chargebacks are governed by Stripe’s terms and our Refund & Cancellation Policy.

4. Acceptable Use

You agree not to misuse the Service, including but not limited to:

• Harassment, threats, coercion, or financial abuse of any kind;
• Illegal activity or violation of third-party rights;
• Reverse engineering, interfering with, or overloading the Service;
• Uploading malware or harmful code.

5. Safety & Consent

HerWay promotes mutual, informed consent. Rules and consequences must be discussed and agreed by both partners. If consent is withdrawn by either partner, you must stop using related features immediately.

6. Intellectual Property

The Service and all materials are owned by HerWay or its licensors and protected by applicable laws. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HERWAY DOES NOT GUARANTEE RELATIONSHIP OUTCOMES OR BEHAVIORAL RESULTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERWAY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

9. Termination

We may suspend or terminate access if you violate these Terms or create risk to users or the Service. You may stop using the Service at any time.

10. Changes to the Terms

We may update these Terms. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
